The National Prosecuting Authority (NPA) has raised concerns about a publication reporting an alleged leak of information concerning upcoming charges for Goodenough Ncedo Kodwa and S V Jehan Mackay.

Leaked details on former Sports, Arts and Culture minister Zizi Kodwa and his co-accused former EOH boss Jehan Mackay charges draw NPA scrutiny.

The duo voluntarily surrendered at Bramley Police Station, following the issuance of warrant of arrests on June 4, 2024.

Hawks spokesperson Brigadier Thandi Mbambo stated that their arrest was part of a larger investigation into corruption concerning state-owned entities, which was prompted by recommendations from the Zondo Commission on State Capture.

“The pair is set to face charges under the Prevention and Combating of Corrupt Activities Act,” she said.

The Authority said it noted with concerns allegations that the attorneys representing certain individuals were not notified of the charges before the information was leaked.

This situation underscores potential violations of established protocols and raises questions about the management of sensitive legal information within the context of the case.

According to the NPA, Kodwa and Mackay’s legal representatives were notified by the former National Director of Public Prosecutions (NDPP) in a letter dated January 29, 2026.

“This communication, directed to Majavu Incorporated and Small-Smith & Associates Inc., indicated that the NDPP has resolved to annul the decision made by the DPP for South Gauteng to withdraw charges.

Authority’s handling of the matter

“Consequently, the prosecution will now proceed with the case. We have committed to handling the matter at hand with the utmost respect and in accordance with legal standards,” the NDPP, Adv Andy Mothibi remarked.

Adv Mothibi emphasized that there has been no information leak regarding this issue, strongly refuting any claims to the contrary.

He further stated that the NPA will not tolerate any leaks, now or in the future.
