A former special task force cop appeared before the Brakpan Magistrates’ Court on Monday for the alleged assassination of a witness known as D from the Madlanga Commission.
Matipandile Sotheni, aged 41, is currently charged with several serious offenses, including conspiracy to commit murder and premeditated murder.
Additionally, he faces three counts of attempted murder and a charge related to unlawful possession of ammunition. These charges indicate a significant legal matter involving potential violent crime.
The case marks a significant legal development connected to issues surrounding witness protection and criminal proceedings in the ongoing investigation.
Marius Van der Merwe, known as Witness D, testified at the Madlanga Commission concerning a murder investigation linked to an incident in Brakpan that occurred in November.
Following his testimony, it is alleged that individuals accused of involvement in this case conspired to assassinate Van der Merwe and actively surveilled him, raising significant concerns about his safety and the integrity of the ongoing investigations.
According to Lumka Mahanjana, spokesperson for the National Prosecuting Authority, on 5 December, the accused allegedly waited near the deceased’s home.
Suspect nabbed in Commission probe
“When the deceased returned home with his wife and two young children, the accused purportedly shot him, resulting in the deceased’s immediate death at the scene.
“Following investigations by the “Madlanga Task Team,” established to investigate cases linked to the Madlanga Commission of Inquiry, an individual was apprehended on Saturday,” she expressed.

The accused has been remanded in custody following a court hearing.
The court has scheduled the next proceedings for 25 March, during which an opposed bail application will be heard.
