Former Sekhukhune United player Mokete Sean Mogaila has pleaded guilty to charges of culpable homicide and failure to render assistance.

The National Prosecuting Authority (NPA) expressed its approval of the conviction of a 29-year-old individual who appeared before the Tembisa Magistrates’ Court.

The individual entered a guilty plea under Section 112(2) of the Criminal Procedure Act. This admission of guilt reflects significant legal consequences stemming from his actions as an athlete.

According to Gauteng NPA communications officer Magaboke Mohlatlole, Mogaila, in his plea statement, acknowledged guilt regarding all aspects of the offences and accepted the facts and allegations set forth by the State.

“The charges arise from a fatal motor vehicle collision that occurred during the early hours of 30 October 2024 on Andrew Mapheto Road in Tembisa.

“Mogaila admitted that the vehicle he was driving veered into oncoming traffic and collided with another vehicle occupied by a woman and her two children.

“The collision claimed the life of nine-year-old Gomolemo Mavimbela, while her mother and 13-year-old brother sustained serious injuries,” he explained.

Mohlatlole stated that after the crash, Mogaila escaped the scene; however, he voluntarily turned himself in to law enforcement later that same day. In the course of the investigation, authorities found bottles of alcohol and drugs in his vehicle.

Guilty plea welcomed

The court subsequently convicted Mogaila on all three charges following his guilty plea. The matter has been postponed to 17 November 2026 for sentencing, with bail extended. Victim impact statements will now be considered.

He added, “[As the NPA] we welcome the guilty plea and conviction, which not only hold the accused accountable for his unlawful conduct but also spare the victims and their family the emotional burden of a lengthy trial.

“The conviction represents an important step towards justice for the deceased child and her family. We remain committed to ensuring accountability for individuals whose unlawful and reckless actions result in death or serious injury.

“Prosecutors will continue to pursue justice on behalf of victims while safeguarding the constitutional rights of accused persons and upholding the principles of due process.”
