The North Gauteng high court in Pretoria will hear the Democratic Alliance’s seminal court challenge to National Energy Regulator of South Africa’s (NERSA) 18.65 percent electricity tariff hike.
Earlier this year, the energy regulator approved Eskom’s annual tariff increases.
DA federal council chairperson Helen Zille will lead the party’s delegation of national and Gauteng leadership at court on Monday.
Zille said the case will also seek to declare load-shedding unconstitutional.
“There are two parts to our case but one has to do with NERSA, and our argument was that they failed to take all the data into account when the multi year price determination was put in place. It’s quite a complex formula, there are two stage.

“The multi year price determination is when public participation takes place, that did not happen, and therefore space was not made for a crucial cross subsidy to help poorer consumers”.
Zille added that the DA is taking this unaffordable and offensive national increase on review, because people across South Africa can no longer afford the out of control price hikes that the ANC national government continues to force onto them across the board.
