He faces a charge under section 6(1) of the Commissions Act 8 of 1947 for failing to present himself before the Madlanga Commission of Inquiry. This charge follows his arrest at OR Tambo International Airport on Thursday night.

It is alleged that Carrim did not appear before the Commission as instructed on 14 August 2026.

Following this alleged non-compliance, a criminal case was initiated and subsequently investigated by the Commission’s Recommendations Task Team.

The National Prosecuting Authority’s regional spokesperson Lumka Mahanjana confirmed the arrest of Carrim just before he was scheduled to board an international flight.

She stated that in court, the State objected to Carrim’s bail release, claiming that he might evade trial and that his unverified addresses would make it difficult for the State to locate him.

Madlanga Commission welcomes former ANC treasurer arrest

Meanwhile, the Commission issued a statement welcoming the arrest of Carrim, stating that his conduct constitutes one or more offences under the Commissions Act (8 of 1947) and its applicable regulations.

According to spokesperson Jeremy Michaels, Carrim has repeatedly not supplied the necessary information and documentation to the Commission as mandated by Regulation 10(6).

“Carrim was identified as a person of interest in October 2025 and was subpoenaed in November 2025 to appear before the Commission, give evidence and provide specified information and documentation relevant to matters falling within the Commission’s Terms of Reference.

“Carrim brought an urgent application before the Gauteng High Court on 5 February 2026 to interdict the Commission from calling on him to file a written statement or subpoena him, pending the determination of his application to review and set aside the Regulation 10(6) notice/s issued for his response. The interdict application was struck off the roll with
costs.

“He then appeared before the Commission on 9 and 10 March 2026 but did not return to the witness stand as scheduled in April, June and July 2026 due to medical reasons.

“On 29 July 2026, the Chairperson delivered a ruling postponing the continuation of Mr Carrim’s evidence to 14 August 2026 and directing him to appear and testify in person on that date, subject to the conditions set out in the ruling,” he stated.

Michaels emphasized that the Commission has faith that Carrim’s arrest will convey a powerful warning to any witness who fails to regard the Commission seriously.

The court has postponed the matter to 19 October, allowing time for the verification of documents submitted by the defense and the continuation of the bail application.
