The uMkhonto weSizwe Party has rejected the recommendation of Judge Aubrey Ledwaba for Judge President of the Gauteng Division of the High Court by the Judicial Service Commission.

Following interviews on Tuesday, the JSC recommended Ledwaba for the top job, amidst scrutiny and public debate about his judgments, emphasizing the appointment’s significance in national discussions.

He was the sole candidate for the leadership role in South Africa’s largest and busiest court division.

According to the party, this decision undermines the integrity of South Africa’s judiciary and betrays the constitutional promise of accountability, transparency, and justice.

MKP spokesperson Nhlamulo Ndhlela said there has been a longstanding tradition within the judiciary to appoint the most eminent jurist to lead the court, and Ledwaba is far from it.

“In a division with over seventy judges, only one candidate was shortlisted; it is palpable that today’s outcome was predetermined as reciprocal patronage.

Concerns raised about Judge Ledwaba’s conduct

“We have consistently expressed serious concerns about Judge Ledwaba’s conduct, citing allegations of corruption, conflicts of interest, and behavior unbefitting a judicial officer.

“These concerns were not speculative; they were grounded in credible reports and reinforced by patterns of behaviour that have eroded public trust in the judiciary,” he remarked.

Ndhlela highlighted that the JSC has opted to promote instead of investigate, despite several clear warnings.

He continued, “This recommendation suggests that allegations of corruption and ethical compromise do not hinder advancement in judicial authority.

“It is concerning that a person with a history of bribery accusations, involvement in protecting politically connected individuals, and defiance against judicial accountability is now leading the busiest High Court in the country.

“This decision confirms the MK Party’s long-standing warning that the judiciary is under threat from internal decay and external political interference.”

Ndhlela stated that the JSC’s actions reveal a systemic failure to protect court independence and credibility, indicating that the Commission has become an enabler of corruption rather than a protector against it.

He opposed the recommendation and urged Cyril Ramaphosa against ratifying the appointment, warning that it would support a contentious judiciary and undermine public trust in the rule of law.

“The MK Party calls for immediate investigations into Judge Ledwaba’s allegations and mandatory lifestyle audits for judiciary members.

“There is a need for a complete overhaul of the judicial appointments process to ensure transparency and accountability, alongside the establishment of an independent body to investigate judicial misconduct.

“The MK Party emphasizes the importance of maintaining an uncompromised judiciary for upholding the rule of law and will actively challenge any decisions that undermine this integrity,” he concluded.
