City of Joburg has seven days to find an acting city manager following a high court judgement declaring Floyd Brink’s appointment unconstitutional, unlawful and invalid.

The Democratic Alliance filed an application in May 2023 to have the application decision reviewed.

Caucus leader Belinda Kayser-Echeozonjoku said they welcome the judgement and have called on the city to immediately implement the remedies ordered by the court.

“This judgement strengthens our resolve to ensure that the Johannesburg council is dissolved so that fresh elections can take place, giving the voters themselves opportunity to resolve the crisis of governance in the city.

“Our victory in this matter safeguards the residents of Johannesburg against further decay and blatant disregard for the rule of law by the coalition that continues to flout processes to purge hard working officials to make way for cadres aligned to them,” she stated.

Kayser-Echeozonjoku insisted that the only way there can be stability in Johannesburg is through the dissolution of council.

Meanwhile, Joburg mayor Kabelo Gwamanda said they are studying the judgement and will in due course advise on the city’s reaction to its contents.

He added that this will be done in consultation with the Speaker as the head of council which is the appointing authority in relation to the position of city manager.

“We wish to reiterate our commitment to acting in the best interests of the residents of the city and its administration at all times. We shall not be deterred nor distracted even in this instance.

“In our attempts to insulate administrative responsibility from political bigotry and in line with our priority of good governance and stabilising the city of Johannesburg, we continue to expect and view these litigious actions with a dim view,” Gwamanda said.
