The City of Johannesburg has filed an application for leave to appeal the decision of the High Court in relation to the Appointment of the City Manager Floyd Brink.

The City says there are a number of legal grounds for concern in the High Court Judgement which the City believes an Appeal Court may decide upon differently.

This automatically suspends the implementation of the Judgement until such a time the application for leave to appeal is considered and if granted, until such a time an Appeal Court Judgment is issued.

A Gauteng Division of the High Court in Johannesburg on Tuesday handed down a judgment which found the processes leading to the appointment of Floyd Brink as city manager nine months ago invalid and unconstitutional.

The City believes it is in the interests of residents that the administrative capacity and stability of the City is defended and insulated from nefarious political interference.

Mlimandlela Ndamase from the executive mayor’s office says the consistent political onslaught and attempts to derail the City’s ability to deliver services and improve governance at an administrative level must be frowned upon and acted against.

Ndamase says the City will continue to dedicate its resources and focus to the urgent needs of residents and service delivery.

“The court has not said anything about him being unqualified or not suitable for the job; it has rather stuck or limited itself to the procedural aspect of the appointment,” said Ndamase.
