The Forum for South Africa (FOSA) has commended the transparency of the public interview process and the involvement of media in the selection of the new National Director of Public Prosecutions (NDPP).

This emanates from the announcement by the Ministry of Justice and Constitutional Development regarding the interview dates for the shortlisted candidates, scheduled for 10 and 11 December 2025.

Advocate Shamila Batohi’s term as NDPP is set to conclude in January 2026, having commenced her duties in February 2019, following the first-ever public interviews for the position in November 2018.

The National Prosecuting Authority (NPA) has seen its NDPP complete a full term for the first time since the NPA’s 1998 founding, without the incumbent facing controversial removal or resignation.

Tebogo Mashilompane, National Leader of the Forum for South Africa, stated that this is a crucial step toward restoring public confidence in the criminal justice system, emphasizing the need for an open, accountable, and credible appointment process for the National Director of Public Prosecutions (NDPP).

“However, we emphasize that South Africa cannot afford another compromised NDPP; the country has suffered immensely under weak, politically influenced, and ineffective prosecutorial leadership.

“We call for a candidate who is independent, fearless, and committed to dismantling corruption without fear, favour, or prejudice. Merit, integrity, and track record must guide the final decision.

“The shortlisted candidates must be evaluated strictly on proven experience in prosecutions, ethical conduct and independence, ability to resist political interference, and a clear plan to reform and strengthen the NPA,” he remarked.

Mashilompane highlighted that South Africans deserve nothing less and urged the Minister and the Advisory Panel to act in the national interest and ensure that party politics do not infiltrate or influence the outcome of this process

He added, “The NDPP is a constitutional guardian of justice — not a political instrument. Public oversight is essential, and we welcome the live-streaming and access for journalists.

“Transparency is a constitutional obligation, not a favour. It must continue throughout the selection process until the final appointment is made. Accountability must follow, regardless of who is appointed.”

Mashilompane emphasised to the new NDPP that the NPA is entrusted with delivering justice in state capture cases, high-profile corruption, violent crime prosecutions, and protecting whistleblowers, highlighting that failure is not an option.
